Purchase Agreement – W0AEZ Radio Gear LLC

This Purchase Agreement ("Agreement") is entered into between W0AEZ Radio Gear LLC ("Seller" or "W0AEZ"), and the customer ("Customer"), collectively referred to as the "Parties," for the purchase of handcrafted and commercially made products ("Products").

1. Product Availability and Production Rates

W0AEZ Radio Gear LLC operates as a small business, with production managed by a single individual (Kevin). Due to this, product availability may be limited, and restocking times may vary. Shipping times can take up to 30 days, depending on demand and production schedules. The Customer acknowledges and agrees that delays may occur and shipping times are estimates.

2. Supply Delays

Delays in sourcing materials or supplies may impact production or restocking times. W0AEZ Radio Gear LLC will make reasonable efforts to notify the Customer of significant delays that may impact the delivery date. We are not liable for delays caused by third-party suppliers or shipping carriers.

3. Handcrafted Nature of Products

Handcrafted products may exhibit minor surface imperfections, variations in texture, color, or design, which are inherent to the handmade process. These unique characteristics do not affect the product's function or quality and contribute to the individuality of each item. The Customer acknowledges that these variations are not grounds for return or refund unless the product is defective.

4. Order Process

All orders are placed through W0AEZ.com. Upon placing an order, the Customer will receive an order confirmation email. Orders are subject to acceptance by W0AEZ Radio Gear LLC, and we reserve the right to cancel or modify an order prior to shipment.

5. Payment

Payment is due at the time of order placement and covers the full cost of the product(s) plus any applicable taxes and shipping fees. We accept payments via PayPal and Credit Cards.

6. Shipping and Delivery

W0AEZ Radio Gear LLC will ship products as quickly as possible. However, unforeseen circumstances (such as supply chain issues or shipping carrier delays) may lead to shipping delays. The Customer is responsible for providing accurate shipping information at checkout. Shipping costs, delivery timelines, and tracking information will be provided upon shipment.

7. Lost Packages and Shipment Issues

We are not responsible for lost, stolen, or delayed packages once they are in the hands of the carrier. If there are issues with delivery (e.g., missing packages or damage during transit), the Customer should contact the carrier directly. For issues with damaged or defective items, please refer to our Returns and Refunds policy.

8. Returns and Refunds

Handcrafted Products: We offer a limited return policy for handcrafted items. Returns for handcrafted products are accepted within 14 days of receipt, subject to the following:

  • A 10% restocking fee applies to all returned handcrafted products.
  • Return shipping is the responsibility of the Customer. The Customer can either cover the return shipping cost directly or have it deducted from their refund amount.
  • Refunds will be issued after the product has been returned and fully processed. If the product is damaged or missing parts, the refund may be adjusted accordingly.

Commercially Made Products: Commercially made products can be returned within 14 days of receipt under the following conditions:

  • The product must be in its original condition and packaging.
  • Return shipping is the responsibility of the Customer, and it may be deducted from the refund.
  • Restocking fee: A 10% restocking fee applies to all returned commercially made products.

Damaged or Defective Products: If a product is received damaged or defective, please notify us within 7 days of receipt. We will work with the Customer to provide a replacement or offer another suitable resolution.

9. Limited Warranty

  • Handcrafted Products: Handcrafted items come with a 6-month limited warranty against defects in materials and craftsmanship. This warranty does not cover damages caused by misuse, accidents, or normal wear and tear.
  • Commercial Products: Commercially made products come with a 1-year warranty for manufacturing defects. This warranty excludes damages caused by misuse, mishandling, or failure to follow the product’s care instructions.

Warranty claims for both handcrafted and commercially made products may require the return of the product for inspection. If a product is deemed defective, W0AEZ Radio Gear LLC may repair, replace, or offer a partial refund, depending on the circumstances.

10. Pricing

Prices for products are subject to change without notice. W0AEZ Radio Gear LLC is under no obligation to honor previous prices, discounts, or promotions unless specifically stated. All applicable taxes and shipping fees will be added during the checkout process.

11. Limitation of Liability

To the fullest extent permitted by law, W0AEZ Radio Gear LLC shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the products, including any damages resulting from defects or improper handling.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, USA. Any legal disputes arising from this Agreement shall be handled in the appropriate courts in Colorado.

13. Amendments

W0AEZ Radio Gear LLC reserves the right to update or modify this Agreement at any time. All changes will be posted on our website, and such changes will take effect immediately upon posting.

By completing a purchase, the Customer acknowledges that they have read, understood, and agreed to the terms and conditions of this Purchase Agreement.
