Purchase Agreement – W0AEZ Radio Gear LLC (Updated 2025)
This Purchase Agreement (“Agreement”) is entered into between W0AEZ Radio Gear LLC (“Seller,” “W0AEZ,” or “we”) and the Customer (“Customer,” “you”), collectively the “Parties,” governing all purchases of handcrafted products, custom-made items, and commercially manufactured products (“Products”).
By completing a purchase, the Customer acknowledges that they have read, understood, and agreed to this Agreement and our Return Policy.
1. Product Availability, Production, and Shipping Timeframes
W0AEZ Radio Gear LLC operates as a small business with production primarily managed by a single individual. Product availability may be limited, and restocking times may vary.

Production and shipping may take up to 30 days, depending on demand.

Shipping times are estimates, not guarantees.

Customer acknowledges that reasonable manufacturing or fulfillment delays may occur.
2. Supply Delays & Force Majeure
Delays caused by suppliers, manufacturers, shipping carriers, or unforeseen circumstances may affect production or delivery.
W0AEZ Radio Gear LLC is not liable for delays caused by:

Material shortages

Third-party suppliers
-
Transportation disruptions
-
Natural disasters
-
Acts of government
-
Carrier delays
-
Events reasonably outside our control
We will make reasonable efforts to notify Customers of significant delays.
3. Handcrafted & Custom-Made Product Characteristics
Handcrafted and printed-to-order products may exhibit natural variations including minor surface imperfections, layer lines, texture differences, or color variations due to filament batches and production processes.
These characteristics:

Do not affect product function
-
Are inherent to handcrafted and 3D-printed goods
-
Are not grounds for return or refund unless defective
4. Order Process and Acceptance
Orders are placed via W0AEZ.com. An order confirmation email does not constitute acceptance. Orders are accepted when W0AEZ begins fulfillment or ships the product, whichever occurs first.
W0AEZ reserves the right to cancel or refuse any order for reasons including but not limited to:

Pricing or typographical errors

Fraud or suspected fraud
-
Policy abuse
-
Material shortages
-
Discontinued products
-
Shipping restrictions
-
Inaccurate Customer information
If an order is cancelled, a full refund will be issued.
5. Payment Terms
Payment is due at checkout and includes:

Product price
-
Applicable taxes
-
Shipping costs
Accepted payment methods include PayPal and credit cards. Orders will not ship until payment clears.
6. Shipping and Delivery
We will ship Products as soon as possible. However:

Delivery estimates are not guaranteed
-
Shipping delays do not constitute grounds for cancellation or refund of shipping fees
-
Customer is responsible for providing accurate delivery information
Tracking information will be provided upon shipment when available.
7. Lost Packages, Delivery Issues & Damage in Transit
LOST PACKAGES, DELIVERY ISSUES & DAMAGE IN TRANSIT
All shipments include $100 insurance coverage through our shipping partners.
Once an order is transferred to the carrier, W0AEZ is not responsible for:
- Lost packages
- Delayed packages
- Stolen packages after confirmed delivery
- Misdelivery caused by incorrect shipping information provided by the Customer
Customer Responsibility: Customers are responsible for entering accurate shipping information during checkout. W0AEZ is not liable for delivery failures resulting from Customer-provided incorrect addresses, apartment numbers, or contact information.
Customers experiencing delivery issues must contact the carrier directly. For insured losses, W0AEZ will assist with filing claims.
For defective or damaged items upon arrival, Customer must follow the Return & Refund Policy and notify us within 7 days with photographic evidence.

8. Returns and Refunds
Returns are governed by our full Return & Refund Policy, which is incorporated into this Agreement by reference.
Handcrafted Products

Commercially Made Products

Must be unused, unopened, and resellable

Non-Returnable Items
Unless defective, the following are not eligible for return:

Custom-built or printed-to-order products
-
Opened electronics, chargers, cables, or batteries
-
Consumable components
-
Items showing installation damage, modification, or wear
Unauthorized returns will not be accepted.
9. Limited Warranty
9.1 Handcrafted Products
Handcrafted items come with a 12-month limited warranty against defects in materials and craftsmanship. This warranty does not cover damages caused by misuse, accidents, improper installation, exposure to moisture, modifications, or normal wear and tear.
9.2 Commercial Products
Commercially manufactured products come with a 1-year warranty for manufacturing defects. This warranty excludes damages caused by misuse, mishandling, incompatible equipment, improper charging, modification, or failure to follow product instructions.
9.3 Warranty Exclusions
The following are not covered under warranty:

Damage from improper installation or integration
-
Water, weather, or environmental exposure (unless product is rated for it)
-
Modifications, soldering, or unauthorized repairs
-
Use with incompatible radios, chargers, cables, or accessories
-
Normal lithium battery capacity loss over time
-
Normal wear and tear
-
Damage resulting from improper electrical connections or unsafe charging practices
9.4 - EXCHANGE POLICY
If a Customer requests an exchange due to receiving a defective or faulty product, W0AEZ Radio Gear LLC will only ship the replacement after the original product has been returned and inspected.
- The Customer must return the defective item using the return instructions provided by W0AEZ.
- Once received, W0AEZ will inspect the product within 5 business days to verify the defect.
- If the defect is confirmed, a replacement unit will be manufactured and shipped according to current production timelines (up to 30 days).
- Total exchange timeline may be 30-60 days from initial return shipment, including return shipping, inspection, production, and delivery.
- If the product is found not to be defective—such as damage caused by misuse, improper installation, incompatible third-party equipment, or other excluded causes—the replacement will not be issued.
- The Customer may choose to have the original item returned to them at their expense.
Exchanges will not be processed or shipped until the defective unit has been fully received, inspected, and approved.
Section 9.5 - WHAT CONSTITUTES A DEFECT:
For purposes of warranty coverage and returns, a product is considered defective if:
- Handcrafted products: Structural failure, cracking, breakage under normal use, components that do not fit as designed, or failure to perform the intended function due to manufacturing error
- Commercial products: Failure to power on, charge, or operate as specified by the manufacturer when used according to instructions
- Electronic components: Non-functionality out of the box, shorts, or failures during normal operation with compatible equipment
Not considered defective:
- Minor aesthetic variations in 3D-printed items (layer lines, texture, slight color variation)
- Cosmetic blemishes that do not affect function
- Incompatibility with third-party or non-approved equipment
- Damage from Customer installation, modification, or misuse
- Normal wear and tear or battery capacity degradation
10. Customer Responsibility for Installation, Use & Safety
Customers are solely responsible for:

Proper installation of enclosures, accessories, or batteries
-
Following all product instructions
-
Ensuring compatibility with radios, chargers, or external equipment
-
Safe handling, charging, transportation, and storage of lithium-based products
W0AEZ is not liable for:
-
Damage to Customer equipment
-
Fire, injury, or property loss caused by misuse
-
Failure to follow safety instructions
-
Improper charging or electrical connections
-
Use with non-approved or incompatible devices
11. Resale Restrictions
Commercial resellers must disclose that products are not manufacturer-authorized for resale. Warranty support and customer service are provided only to the original purchaser. Resold products may not be eligible for warranty claims or returns.
12. Limitation of Liability
To the fullest extent permitted by law, W0AEZ Radio Gear LLC is not liable for:

Direct, indirect, incidental, or consequential damages

Damage to Customer equipment
-
Loss of data, income, or business
-
Injuries or property damage resulting from product use
Customer agrees that total liability of W0AEZ, if any, shall not exceed the price of the purchased Product.
13. Chargebacks
Customers experiencing issues with their order should contact W0AEZ at [kevin@w0aez.com] before initiating a chargeback.
Initiating a chargeback without contacting W0AEZ first:
- Pauses all refunds, replacements, or warranties until resolved
- Fraudulent chargebacks may result in account suspension and legal action
14. Privacy and Communications
By placing an order, Customer consents to receive transactional emails, including:

Order confirmations

Shipping notifications
-
Updates related to their purchase
Personal information is handled in accordance with our Privacy Policy.
15. Amendments
W0AEZ Radio Gear LLC may update or modify this Agreement at any time. Changes take effect immediately upon posting to the website.
16. Severability
If any provision of this Agreement is found unenforceable, the remaining provisions remain in full effect.
17. Governing Law
This Agreement is governed by the laws of the State of Colorado, USA.
Any disputes shall be resolved in the appropriate courts or arbitration forums located in Colorado.
By purchasing from W0AEZ Radio Gear LLC, the Customer acknowledges and agrees to all terms outlined in this Purchase Agreement and the accompanying Return Policy.
